Experience

Experience helps you learn about the everyday realities of working life and most importantly equips you with the soft skills needed to succeed at any organization. In addition to having knowledge and experience in a trade or profession, expert implies extraordinary proficiency and connotes knowledge and technical skill. Popular belief is that the key to becoming an expert is to devote at least 10,000 hours to the study and practice of a subject. Expertise is defined as exceptional, elite, or peak performance on specific tasks in specific domains. Expertise is perceived as being the result of hard work and practice. Life experiences are the events and situations that shape our individual journeys and contribute to personal growth and development. The happiness provided by new material possessions is short-lived. Over time, people's satisfaction with the things they buy decreases, whereas their satisfaction with experiences over time increases. Experience is making mistakes and learning from them. The trouble with experience is that by the time you have it you are too old to take advantage of it. Experience is what you get when you did not get what you wanted. Good judgement comes from experience, and experience comes from bad judgement. Fill your life with experiences. Not things. Have stories to tell, not stuff to show.

Of all the things needed to do something right, experience counts the most. What counts most is the energy or enthusiasm to do it. Finding both of these together is rare, which explains why our world is less than perfect. The famous saying "If one could learn from watching alone, then even the dog would become a butcher" elegantly outlines why and how experience counts. Experience is better and there is a very thin line between experience and monotony. Several companies has seen a paradigm shift from the experienced candidates getting preference to freshers being hired in large numbers and now it is shifting back again to the experienced. How far this is correct remains a question of debate. For all that youth lacks, experience can compensate. For all that old age is incapable of achieving, youth could become the instrument. There has been growing acceptance of the need to make retirement a gradual process. This could be done by reducing working hours gradually till retirement or breaking the monotony as retirement approaches by setting more enjoyable roles for them. By recognizing the worth of the experienced and the potential of the youth and making them work together, youth would know much more and aged could do much more.

Lawyers - Duties & Responsibilities.

We all know that in the courts, judgments are primarily reflection of evidence (right or wrong) and arguing capability of advocates. They need not necessarily be truthful and just. Most judgments do not reflect either truth or justice, now a days.

Justice is justice if only it is truthful apart from being compliant of laws of the land.

The sacred duty of Advocate is to argue for clients and assist court in arriving at truthful judgments. If their client is right then they should struggle to get favorable judgement and if client is wrong he should struggle to get least punishment. Never a lie should be established as truth. Never a genuinely innocent person should awarded punishment. Otherwise Judiciary loses its sacredness and relevance.
  • In between the complainant and accused one is right and other wrong.
  • Advocate of the wrong doer is the first person to grasp the full truth of the situation.
  • He should convince his client to plead guilty and get away with least punishment, having committed the offence.
  • Advocates should never encourage clients to tell lies in the court. It is the duty of advocates assist the court in delivering truthful judgments. Otherwise they would be driving the nation towards anarchy.
  • People do wrong things and make huge amounts of money. The bigger the wrongdoing the greater is the quantum of money. Naturally they have capability to spend huge amounts of money defending their cases in courts and pay hefty fees to lawyers. Many famous Supreme Court advocates, today, are paid fees at Rs. one lakh per hour apart from travel by chartered aircraft, 5* hotel stay and commute by BMW cars. No honest person can avail his services at this price tag. Almost all his clients are thugs and hooligans.
  • I remember Bharat Shah, Mumbai based diamond merchant and hindi film producer accused of mafia & extortion activities was in jail without bail for over 18 months during 2001-2002. His bail petition was set aside by courts 14 times. Finally he was convicted in 2003. Imagine how much fees he must have paid to his advocates (almost all best advocates of the country represented his case). The talk of the town then was each bail petition he paid Rs. one crore as fees, mostly in cash. What was the necessity for these famous, rich and learned advocates to fly from Delhi to Mumbai in chartered plane and defend a known thug in Magistrate courts? It is just money and nothing else.
  • It is worthwhile to recollect the story of Justice Jagmohanlal Sinha, Allahabad High Court judge who disqualified Prime Minister Indira Gandhi in an election petition case and subsequent events led to Emergency declaration by Indira Gandhi in 1975.

"Resolve to be honest at all events; and if in your own judgment
you cannot be an honest lawyer, resolve to be honest without being a lawyer.
Choose some other occupation ... Abraham Lincoln"

"Discourage litigation. Persuade your neighbors to compromise
whenever you can. As a peacemaker the lawyer has superior opportunity
of being a good man.  ... Abraham Lincoln"

SC Slaps on Modi's face in Arunachal Pradesh Imbroglio

Supreme Court literally slapped on Modi's face this morning with 5 judge bench unanimously setting aside the BJPs adventures in overthrowing Congress government without following the statutory procedure and using Governor as its political puppet.

The Nabam Tuki-led government was dismissed following days of turmoil after 21 of the 47 Congress MLAs rebelled against the chief minister. Arunachal Pradesh was placed under President's rule on January 26. Just before the apex court had reserved its verdict on February 20 this year, rebel Congress leader Kalikho Pul was sworn in as chief minister of Arunachal Pradesh with the support of 18 dissident Congress MLAs and two independents and 11 BJP MLAs who gave outside support in the 60-member assembly.

The five-judge constitution bench, was headed by Justice J S Khehar and other members were Justices Dipak Misra, M B Lokur, P C Ghose and N V Ramana.

Justice Khehar pronounced the voluminous main judgement and read out the operative portion, saying that
  1. "the order of the governor dated December 9, 2015, preponing the session of legislative assembly from January 14, 2016, to December 16, 2015, is violative of Article 163 read with Article 174 of the Constitution and as such is liable to be quashed and the same is quashed".
  2. "Secondly, the message of governor directing the manner of conducting the proceedings of the sixth session of legislative assembly of Arunachal Pradesh from December 16-18, 2015, is violative of Article 163 read with Article 175 of the Constitution and as such is liable to be quashed and the same is quashed," the bench said.
  3. Thirdly, the bench said "all steps and decisions taken by the Legislative assembly of Arunachal Pradesh in pursuant to governor's order of December 9, 2015, are unsustainable and liable to be set aside and as such it is set aside."
  4. Finally, the bench said "In view of the decision from one to three, status quo ante as it prevailed on December 15, 2015, is ordered to be restored."
My view: Governor must resign immediately and also Union Home Minster & Law Minister, for playing dirty politics abusing constitution and laws of the land, if they have any shame. Being Prime Minister Modi should cultivate habit of respecting non-BJP governments and their rights. What is the point in practicing Yoga, Medication and Religion etc without these qualities? As PM he should be above dirty politics. He should also take advise from luminaries, legal and otherwise, before taking decisions with far reaching consequences.
