Ayodhya verdict - Reminiscences

Nearly 3 decades ago, on December 6, 1992, a long-running dispute between Hindus and Muslims over a religious site in the northern city of Ayodhya took a dramatic turn (Babri Masjid demolished) and changed the course of Indian politics forever. Religious riots erupted, and 900 people, both Muslims and Hindus, were killed in Mumbai. And on March 12, 1993, 13 blasts ripped through the Mumbai city in retaliation for the mosque’s demolition, killing 317. Now, a verdict from the Supreme Court (on Nov 9, 2019) has legally closed the most divisive religious conflict and paved the way for the construction of a Hindu temple at the site. The court has insisted that a mosque also be built, but on an alternative plot of land.  This SC decision will allow the BJP and Modi government to bolster its political fortunes further by construction of a grand Ram temple just ahead of elections in Uttar Pradesh due in March 2022.
  • Real closure of the conflict will depend on how, going forward, India treats its more than 175 million Muslim citizens. Anything other than equitable justice will only leave deep scars and gaping wounds.
  • Since there has been no violence and protests, we should not mistake this for indifference. But this doesn't entail Muslims accepting the construction of a Ram temple at the site. The court has said that the demolition of the mosque was “a serious violation of the rule of law” and that “it is necessary to provide restitution to the Muslim community for the unlawful destruction of their place of worship.”  Justice in the Babri masjid demolition case is critical to Indian democracy’s promise of fair play and equality.
  • In the 2019 election, BJP fielded only seven Muslim candidates. In the 2017 assembly elections in Uttar Pradesh, where the temple will be built and has 19.3% Muslims (about 4.40 crores), the BJP did not field any Muslim candidates. India owes it to Muslim citizens to address this sense of political marginalization.
  • It was the Muslims who suffered the razing of their place of worship; they were also the victims of the violence which followed. The community sought redressal and placed its faith in the institutions for justice. The Supreme Court ruling is riddled with contradictions but its biggest problem is the loss of faith it has triggered among Muslims about the possibility of justice. What can be worse for a democracy when its largest minority group does not hope for justice but fearfully settles for a verdict that they know is no less than injustice to them? -- Arfa Khanum Sherwani writes in thewire.in

The PM Modi's appeal for harmony, on the eve of the Ayodhya verdict, and warning against seeing the outcome as a victory or defeat for either side casts doubts about his prior knowledge and influencing the judgement. Muslims may grudgingly and helplessly accept this verdict with a pinch of salt but in the reverse scenario, Hindu groups (RSS, VHP etc) would definitely have pressurized central government to promulgate ordinance allotting Babri Masjid plot for Ram Janmabhoomi temple construction.

Nehru is the greatest PM India

The modern history of India cannot be analysed without understanding the decisive roles played by Pandit Jawaharlal Nehru and Indira Gandhi. These two leaders were the founders of modern India. Among the two, the contribution of Jawaharlal Nehru has been so significant that it will have an impact on generations to come. Nehru pulled India out of the economic crisis after Independence. As a result, India is almost at par with other industrialized countries of the world.
  • At the time of independence, India is saddled with poverty, illiteracy and distressed farmers. Hence Nehru prioritized development. His policies always kept the poorest sections of society in mind. He allocated the nation’s wealth without ignoring the poor.
  • India was never a poor country. Its wealth was drained after 200 years of colonial rule. 
  • After Independence, Nehru wanted the direct involvement of poor people in the process of development. This way their lost self-esteem and pride could be restored. He had a conflict of interest with other party leaders regarding the establishment of parliamentary democracy in India. There was a point where he stood against his father Motilal Nehru’s Swaraj Party.
  • India today is just a glimpse of Jawaharlal Nehru’s foresight.
  • Some critics hold Nehru responsible for the Kashmir issue. But they forget that Jammu and Kashmir was a princely state. It was Maharaja Hari Singh of Riyat who expressed his desire to join India when Pakistan invaded the princely state.
  • It was the education system created by Nehru that enabled students from ordinary families to reach extraordinary heights. Nehru also strengthened the health services like the AIIMS. But today we have destroyed Nehru’s legacy by turning educational institutions as well as hospitals to mere money-making machines.
  • Nehru ultimately passed away one and a half years after China’s betrayal in 1962, shaken to the core.
  • Indira Gandhi also faced severe economic crisis after the death of Lal Bahadur Shastri. But she tackled it by devaluing the currency for the first time. Indira Gandhi showed that the Partition of Pakistan in 1971 was a political ploy in the name of religion. 
  • V.P. Singh who took Indians one step backward as a civilisation by dividing them on the basis of their caste, creed and ethnicity. The country’s economy had already been eroded to a great extent by the policies of V.P. Singh and Chandrashekhar. 
  • Notwithstanding the contributions of PV Narasimha Rao and Manmohan Singh in saving India going bankrupt in 1992 with liberalization, Rao has been the weakest and most inefficient prime minister of this country by far. He opened the markets to foreign investors which in turn robbed the hard-earned wealth of Indians. Narasimha Rao nervously opened the Indian market to foreign companies and agreed to put off foreign exchange payoff. Narasimha Rao completely destroyed the secular heritage by letting Babri Masjid get demolished in front of his own eyes. This has led to communal tensions in the country. 
  • Atal Bihari Vajpayee’s government ruled for six years. In spite of this, it could not reduce financial scams in the country. He formed a new disinvestment ministry to sell off government assets. Vajpayee used humour to further parliamentary democracy. Yet to a great extent, he has kept the spirit of Nehru alive in his policy decisions.
  • Charan Singh, Deve Gowda, IK Gujral and Manmohan Singh had been ‘accidental’ Prime Ministers. It is not known why Morarji Desai was honoured with Pakistan’s biggest national honour of “Nishan-e-Pakistan”. 


Today, I find many people who criticize Gandhi, Nehru, Indira Gandhi etc as the cause for what ever problems we face today but I have no doubt to categorize them as ignorant, blind and mad. It is not our culture to criticize our great grand father's for what they have done or haven't done. It won't be easy to imagine the situations or dilemmas they might be facing at that time given the paucity of knowledge, talent & resources.

Modi: Killing in the name of gau bhakti not acceptable


My View:
BJP, RSS, Bajrangdal - all same has always resorted to violence and mob killings of Muslims for consolidating their positions or achieving new heights. 
  • 1992: Advani spearheading rath yatra that ended up demolishing Babri Masjid with precision and speed of six hours, without any casualties, unleashing violence catapulted BJP from 2 in 1984, to 84 in 1991 and to 120 in 1991 and eventually landing in power in 1996, 1998 & 2000. Advani couldn't become PM in preference to his senior and mentor AB Vajpayee.
  • 2001: Modi succeeded in dislodging Keshubbhai Patel and backstabbing Sankar Singh Vaghela and became CM of Gujarat. He consolidated power, to some extent, by resorting to elimination of his minister Haren Padya. Amit Shah's controversial role in murders resulted in Supreme Court debarring his entry into Gujarat for two years 2010-2012.
  • 2002: Gujarat riots that lasted two months killing about 2,000 Muslims by Hindu mobs led by Bajarangdal, facilitated by Modi, his Cabinet, his Administration and Police. Maya Kodnani, who spearheaded single biggest Naroda-Patiya massacre of 90 Muslims in a single day was rewarded with Minister's berth by Modi. Later Kodnani was sentenced and Modi facilitated her bail is another story.
  • 2002: Even though 100,000 Muslims were displaced during riots and haven't returned to their homes, how Modi pressurized Election Commission agree for mid term poll and convinced them all refugees returned to their homes and rehabilitation completed (even today some 15,000 displaced Muslims are living in outskirts of Ahmedabad), through Advani's Home Ministry for midterm poll in Dec 2002, is a mystery.
All BJP leaders who ever resorted to violence against Muslims during past two decades are now enjoying powerful positions, the latest being Yogi Adityanath, CM of UP.

Hence Modi's talk after two months of Vigilante groups massacring beef eaters etc is nothing but an eye wash and delayed condemnation of attacks tantamount to approving the attacks on minorities especially Muslims in the name of gau rakshaks or any thing else.

The Supreme Court's directive to complete the conspiracy trial against BJP leaders accused of conspiracy to demolish the Babri Masjid could mean the deserved denouement of Lal Krishna Advani's career. Advani's career was built on Babri Masjid, on the saugandh that a Ram Mandir would be built in its place and nowhere else. If Advani gets indicted for the demolition of the structure in Ayodhya, life would have come full circle for him.

There shouldn't be an iota of doubt that Advani, now 89 years, was the architect of the movement that led to the demolition of the disputed mosque on Dec 6, 1992. His rath yatras led to mass hysteria that mobilised thousands of youth for the sectarian movement. It is for the courts to decide if Advani, Murli Manohar Joshi, Uma Bharti, Kalyan Singh and other BJP leaders accused in the case actually conspired to get the structure razed or not. But, none of them can escape the moral and political responsibility of their failure to control the monster they unleashed on India and in Ayodhya.

Advani has always denied that he was aware of plans to forcibly demolish the structure. He has claimed that the sight of lumpen kar sevaks pulling the structure brought tears to his eyes. Other versions suggest that they are in fact tears of joy when their conspiracy came to fruition on Dec 6, 1992. Advani played up the kamandal card ruthlessly throughout the tumultuous period between 1989 and 1992. He was single-handedly responsible for taking the BJP from 2 seats in 1984 to 117 in 1991 and his ambition to become the prime minister is clear.

For the BJP, the SC order could be a blessing in disguise. To the party it could mean an opportunity to keep the Hindutva pot boiling and serving the Ram Mandir issue hot in the 2019 elections. The trial is bound to get a lot of attention and in the end turn out a PR heist for the Hindutva brigade. In the dusk of his life, he could become the rath on which his party could ride to the next electoral victory. Just that, like in the 90s, he might not be the beneficiary of his final yatra, either to jail (if he is indicted) or to freedom (if he is found not guilty). Wouldn't that be adequate punishment for Advani's karma that led to the bloodshed every time he roared: Saugandh Ram ki khaate hain, mandir wahin banayenge?

My View:
The fact that BJP etc have given written assurances that they would not demolish Babri Masjid for obtaining permission to conclude 'Rath Yatra' in Ayodhya and failed is one aspect. The other aspect is that gigantic structure demolition and removing debris using construction equipment would have taken few days where as 'Kar Sevaks' using hand tools only have demolished the structure, cleared debris and installed make shift 'Ram Mandir' in flat 6 hours, without any causalities, indicates the well designed, equipped and rehearsaled conspiracy, with secrecy well maintained, speaks volumes about the criminality of the issue for which LK Advani, Murli Manohar Joshi, Uma Bharti, Kalyan Singh and other BJP leaders can't be absolved of their crime and must be punished. However after 25 years, mobilising witnesses for their trial is no easy task for CBI and with Modi & BJP in power at Centre and also in UP, it is quite possible that the trial will end up as a farce. However Advani will go down in history as destroyer of Babri Masjid and pushing secularism into peril and paving way for Hindutva, much to the discomfort of minorities.

Post independence in India, Hindu population is growing arithmetically where as Muslim population is growing geometrically and by 2051/61 Muslim population will surpass Hindu population in India. Then what?

Babri case: SC restores conspiracy charges against Advani etc

Apr 19, 2017:  LK Advani and other top leaders of the BJP including Murli Manohar Joshi and Uma Bharti will be tried for criminal conspiracy in the demolition of the 16th­ century Babri Masjid, the Supreme Court ruled today, agreeing with a request from the Central Bureau of Investigation or CBI in its case over the razing of the disputed mosque on December 6, 1992. The incident had sparked deadly riots across India that killed around 2,000 people. "We have allowed the CBI appeal against the Allahabad High Court judgement with certain directions," a bench comprising Justices PC Ghose and RF Nariman said.

Here are the top 10 points from the judgement in the Babri Masjid demolition case:
  1. CBI's appeal in Babri mosque demolition case allowed, criminal conspiracy charge against LK Advani and other BJP leaders restored.
  2. Two separate cases (in Lucknow and Raebareli) against LK Advani, Murli Manohar Joshi, Uma Bharti and unknown 'kar sevaks' in will be brought together in one trial.
  3. The trial court in Lucknow must complete the hearing in two years and deliver a verdict.
  4. Kalyan Singh (who was the chief minister of UP in 1992) enjoys constitutional immunity as Rajasthan Governor and can be tried only after he leaves office.
  5. Lucknow court should conduct trial in these cases on a day­to­day basis.
  6. No party shall be granted adjournments without the sessions judge being satisfied of the reasons for it.
  7. CBI will have to ensure that at least one prosecution witness appears in trial court for recording of testimony.
  8. Trial judge hearing the Babri mosque case shall not be transferred till the judgement is delivered.
  9. Lucknow trial court to commence proceedings in four weeks and there will be no 'de novo' (fresh) trial.
  10. Order should be followed in letter and spirit and parties involved have the liberty to approach the top court if its directions are not followed.

My View:
There is no question that Ram Janmabhoomi is one of the highest sentiment for 84% Hindus in India, without exception. Muslims should have voluntarily given away the never used Masjid for Hindus for building Ram Temple, as gesture of good will. In return they could have extracted certain concessions, but both groups never came to negotiating table. Courts could not give its judgement because that piece of land of Babri Masjid is in possession of Babri Masjid Trust and at the same time Hindus sentimental right can't be undermined but can't be given away to Hindus unless Muslims agree to it. The dispute is dated back to 1853/1859. In 1992 Advani leading thousands of BJP+ Kar Sevaks, purely for political gains is only to counter VP Singh's Mandal card, resulting in demolition of Babri Masjid is patently illegal, undemocratic and unconstitutional and ruptures secular fabric of the nation. All culprits who ever have conspired and/or participated in demolition must be booked and punished as per laws of the land. Topping the list are LK Advani, MM Joshi, Uma Bharathi, Kalyan Singh and many more. At least after 25 years, SC ordered these culprits stand trial with 2 years deadline. Unless rule of the law is respected, we stand to lose democratic & secular character of our constitution.

However, SC has dealt a deadly blow to BJP & its associates stunning the master manipulator Modi affirming judicial independence and upholding rule of law. Any shame left, Uma Bharti and Kalyan Singh must resign their Minister & Governor positions and face criminal charges in their individual capacity. Ironically, Modi (with his CBI) has to prosecute his own gurus & compatriots of conspiracy & criminal charges. Landed in unenviable spot, Modi, who lectures on every issue, will maintain stoic silence on this matter.
